Frequently Asked Questions
As personal injury lawyers, we receive many questions about the law and how to file a personal injury lawsuit. These are just a few of the questions we receive.
How is my legal team compensated?
For most lawsuits for injuries, the attorneys are paid on a contingency contract. This means that the attorneys are paid only if and when you recover an amount stated in the attorney/client agreement.
What happens if I don’t recover any money in my injury lawsuit?
Unfortunately, this can be a possibility, the justice system is not perfect. In the event the case does not settle and a verdict is rendered for the defense, you, the client, will not be responsible for the expenses associated in the preparation of the case.
Is litigation easy?
It is easy to file a lawsuit. However, it is complicated and often times frustrating to be in litigation. That is why it is important to have our attorneys on your side every step of the way.
How long will my case take?
The time varies depending on the nature of the case as well as the injuries. Some cases can resolve quickly, in a matter of months, some take a year or two and other still take longer.
Will my case go to trial?
We, at Loizzi Cardenas Law, understand our client’s needs. Sometimes the facts of the case dictate going to trial. Sometimes, they dictate accepting a settlement offer. We will discuss with you all the possible outcomes as well as the likelihood of victory at trial. We will make a recommendation based upon our experience, but whether a client accepts our recommendation is strictly up to the client. The client has the ultimate say in what happens in his or her case.
Do I have to pay my medical bills during litigation?
Yes, unless you are able to get an agreement from your doctor to wait to be paid for any recovery you receive. You should continue to submit bills to your insurance company as well as pay any amounts you personally owe.
