Litigation: What should I expect?
Is it like what we see on TV? No, not really. While no two cases are similar, they tend to follow roughly the same general outline.
Even before a case is filed, we collect all of the records (like medical records, medical bills, police or accident reports, etc) so that we can get a better sense of what happened and understand the treatments received. Second, we file a lawsuit: the Defendants are served, they have an opportunity to obtain an attorney and answer the complaint. Third, we go through a stage of information gathering with the Defendants (called discovery). Fourth, we take depositions of the parties, witnesses, treating doctors, and experts. Lastly, we proceed to trial. At any point along this timeline, the parties can also reach a settlement.
